PennEngineering Litigation Finds PENCOM Made False Statements About Their Products
Subject Case (Civil Action No. 2:1900513-GAM)
(Danboro, PA., 12/03/2024) – Penn Engineering & Manufacturing Corp. (“PennEngineering”), announces that on November 1, 2024, in a lawsuit filed against Peninsula Components, Inc. (“PENCOM”) in which William Gardiner, PENCOM’s owner, testified that it was his decision for PENCOM to reproduce PennEngineering’s performance data. The Jury unanimously found that:
- PENCOM made literally false statements about its own products;
- PENCOM’s false statements about its own products were material and that they were likely to influence customer’s purchasing decisions; and
- PENCOM’s misleading statements about its own products were material and that they were likely to influence customers’ purchase decisions.
The Jury also found that PENCOM had used PennEngineering’s (“PEM”) trademark in Google ads in a manner that is likely to cause confusion among purchasers as to the source of PENCOM’s products.
